my velocity on my ripper is jumping from like 120 to 260 every other shot. what could it be?

It could be a lot of things. I'd start by replacing your HPR and LPR o-rings and relubing with Dow 55. Check for bent pin valves and any damage to the interior of your Torpedo reg wall.

the weird thing is is this is a brand new gun. its 05 but never used.

Listen to Lopez...(you are getting sleeeepy..)
Could be old lube and set-up orings. Some lube can dry out and either get pasty or gummy. If it was "used once" they may have used a petroleum based lube on it, which are highly varied in aging. If it was stored in an attic (or near a furnace) both the rings and lube will be unpredictable regardless of the lube.
Make sure the battery is good. The frenzy and virtue boards seem to behave a little different from each other on low batteries.
